The Director of Public Works' approval of

the centre pole system was a concession as the poles obstruct

traffic and as the tracks, being 6' 6" apart, occupy a greater

width of the roadway.

"The Director of Public Works was induced

to make this concession partly by the Company's voluntarily

undertaking to concrete the whole 6' 6" as shown in the cross

section.

G.

The cross-section was duly approved by

the Director of Public Works under the Ordinance Section 13

which provides inter alia, that the work shall be executed in

accordance with such approved cross-section.

H.

Construction has actually been begun under

the approved cross-section in certain localities.

No twithstanding this correspondence the

Director of Public Works reported under date of the 15th.

ultimo (copy of minute attached) that the Resident Engineer

of the Tranway Company had disregarded his letter of the 20th.

of July and had caused a length of double track of Tramway to

be constructed contrary to the approved cross-section. In

consequence of this action I have authorised the Director of

Public Works to inform the Company's Resident Engineer that

the Company having repudiated the approved cross-section must

under Section 13 of the Ordinance lay before the Director of

Public Works a new cross-section for such portions of the

road as they may in future propose to open. Unless the Director

of Public Works approves of the cross-section the Company

cannot
